Service Terms and Conditions

I. General Terms

  1. Terms and Conditions – these terms and conditions
  2. Service – the website "EccoParts.eu", operating at https://eccoparts.eu
  3. Service Provider – the company "EccoParts sp. z o.o." with its registered office at ul. Zakładowa 143, NIP: 7282863418, KRS: 0000977965
  4. Service Recipient – any individual accessing the Service and using the services provided through the Service by the Service Provider.
  5. Electronic Communication – Communication between parties via email and contact forms available on the website.

II. General Provisions

  1. The Terms and Conditions define the rules of operation and use of the Service and specify the rights and obligations of the Service Recipients and the Service Provider related to the use of the Service.
  2. The subject of the Service Provider’s services is the provision of free tools in the form of the Service, enabling Service Recipients to access content in the form of entries, articles, audiovisual materials, or web applications and electronic forms.
  3. Any content, articles, and information containing features of guidelines or advice published on the Service are merely a general set of information and are not directed to individual Service Recipients. The Service Provider is not responsible for their use by Service Recipients.
  4. The Service Recipient assumes full responsibility for the manner of using the materials made available within the Service, including their use in accordance with applicable law.
  5. The Service Provider does not guarantee the suitability of the materials placed on the Service.
  6. The Service Provider is not responsible for any damages incurred by Service Recipients of the Service or third parties in connection with the use of the Service. All risks associated with the use of the Service, in particular the use and utilization of information placed on the Service, are borne by the Service Recipient using the services of the Service.

III. Conditions of Using the Service

  1. The use of the Service by each Service Recipient is free and voluntary.
  2. Service Recipients are required to familiarize themselves with the Terms and Conditions and other documents constituting its integral part and must accept all its provisions to continue using the Service.
  3. Service Recipients may not use any personal data obtained from the Service for marketing purposes.
  4. Technical requirements for using the Service:
    1. A device with a display allowing the display of web pages,
    2. Internet connection,
    3. Any web browser that displays web pages in accordance with the standards and provisions of the W3C Consortium and supports web pages made available in HTML5,
    4. Enabled JavaScript support,
    5. Enabled Cookie support
  5. To ensure the security of the Service Provider, Service Recipients, and other Service Recipients using the Service, all Service Recipients should adhere to the generally accepted internet safety rules,
  6. It is prohibited to perform actions personally or using software:
    1. Without written consent, decompiling and analyzing the source code,
    2. Without written consent, causing excessive server load of the Service,
    3. Without written consent, attempting to detect vulnerabilities in the Service's security and server configuration,
    4. Attempting to upload or inject code, scripts, and software that may harm the Service's software, other Service Recipients, or the Service Provider,
    5. Attempting to upload or inject code, scripts, and software that may track or steal data of Service Recipients or the Service Provider,
    6. Attempting any actions aimed at damaging, blocking the operation of the Service, or preventing the achievement of the purpose for which the Service operates.
  7. If an incident of Cybersecurity or a violation of GDPR is detected or has the potential to occur, Service Recipients should first report this to the Service Provider to quickly resolve the problem/threat and secure the interests of all Service Recipients of the Service.

IV. Terms and Conditions of Registration

  1. Service Recipients can use the Service without registration.
  2. Service Recipients must be registered and have an account on the Service to use additional services provided in the Service, available only to logged-in Service Recipients.
  3. Registration in the Service is voluntary.
  4. Registration in the Service is free.
  5. Each Service Recipient may have only one account in the Service.
  6. Technical requirements for account registration:
    1. Having an individual email account,
  7. Service Recipients registering in the Service agree to the processing of their personal data by the Service Provider to the extent that they were entered into the Service during the registration process and their subsequent changes or deletion.
  8. The Service Provider has the right to suspend or delete Service Recipients' accounts at its discretion, thereby preventing or restricting access to certain or all services, content, materials, and resources of the Service, especially if the Service Recipient violates the Terms and Conditions, generally applicable laws, social coexistence principles, or acts to the detriment of the Service Provider or other Service Recipients, the legitimate interest of the Service Provider, and third parties cooperating or not with the Service Provider.
  9. All services of the Service may be changed in their content and scope, added or removed, as well as temporarily suspended or access to them may be restricted, at the Service Provider’s sole discretion, without the possibility of objections by the Service Recipients in this regard.
  10. Additional security rules for using the account:
    1. Registered Service Recipients are prohibited from sharing their login and password to their account with third parties.
    2. The Service Provider does not have the right and will never request the Service Recipient’s password to the selected account.
  11. Deleting an account:
    1. Each Service Recipient with an account in the Service can delete the account independently.
    2. Service Recipients can do this after logging in to the panel on the Service.
    3. Deleting the account results in the removal of all identifying data of the Service Recipient and the anonymization of the username and email address.

V. Terms of Providing the Newsletter Service

  1. Service Recipients can use the Service without subscribing to the Newsletter.
  2. Subscribing to the Newsletter service is voluntary.
  3. Subscribing to the Newsletter service is free.
  4. Technical requirements for the Newsletter service:
    1. Having an individual email account,
  5. Terms of providing the Newsletter service:
    1. Providing an individual email account in the electronic form,
    2. Verification of the provided email account by activating the link sent to it,
    3. Consent to receive email notifications,
  6. Scope of the Newsletter service:
    1. Notification of new updates, posts, contests, and other promotional activities related to the Service’s services,
    2. Notification of promotional activities of the Service’s partners (Marketing messages),
  7. Unsubscribing from the Newsletter service:
    1. Each Service Recipient subscribed to the Newsletter service can unsubscribe independently.
    2. Service Recipients can do this through the link provided in each email sent.
    3. Unsubscribing from the Newsletter service results in the removal of the provided email address from the Service Provider’s database.

VI. Terms of Communication and Providing Other Services in the Service

  1. The Service provides services and tools enabling Service Recipients to interact with the Service in the form of:
    1. Contact form
    2. Commenting on posts and articles
  2. The Service provides contact details in the form of:
    1. Email address
    2. Contact phone number
  3. In the event of contact by the Service Recipient with the Service Provider, the personal data of the Service Recipients will be processed in accordance with the "Privacy Policy", which is an integral part of the Terms and Conditions.
  4. Conditions for posting content by Service Recipients in the Service:
    1. It is forbidden to post offensive or defamatory content regarding the Service Provider, other Service Recipients, third parties, and third-party entities,
    2. It is forbidden to post textual, graphic, audiovisual materials, scripts, programs, and other works for which the Service Recipient does not have a license or for which the author of the proprietary rights has not given consent for free publication,
    3. It is forbidden to post vulgar, pornographic, erotic content and content contrary to Polish and European law as well as links to sites containing such content,
    4. It is forbidden to post scripts and programs that excessively load the server, illegal software, software used to violate security, and other similar activities as well as links to sites containing such materials,
    5. It is forbidden to post marketing and advertising content of other commercial services, products, services, or commercial websites.

VII. Collecting Data on Service Recipients

To properly provide services by the Service, ensure the legal interest of the Service Provider, and ensure compliance of the Service with applicable law, the Service Provider collects and processes certain data about Users through the Service.

To properly provide services, the Service uses and stores certain anonymous information about the Service Recipient in cookies.

The scope, purposes, method, and principles of data processing are available in the attachments to the Terms and Conditions: “RODO Information Obligation” and in the “Privacy Policy”, which are an integral part of the Terms and Conditions.

  1. Data collected automatically:
    To ensure the efficient operation of the Service and for statistics, we automatically collect certain data about the Service Recipient. This data includes:
    1. IP Address
    2. Browser Type
    3. Screen Resolution
    4. Approximate Location
    5. Visited subpages of the service
    6. Time spent on the relevant subpage of the service
    7. Type of operating system
    8. Address of the previous subpage
    9. Referring site address
    10. Browser language
    11. Internet connection speed
    12. Internet service provider
    13. Anonymous demographic data based on Google Analytics data:
      1. Gender
      2. Age
      3. Interests
    14. Anonymous data necessary for serving ads:
      1. Data related to remarketing
      2. Data related to ad display reporting

    The above data is obtained through the Google Analytics script and is anonymous.

  2. Data collected during registration:
    Username, first and last name, email address

    In the case of logged-in Service Recipients (having an account in the Service), an identifier linked to the Service Recipient's account may be placed in the cookies saved on the Service Recipient's device.

  3. Data collected when subscribing to the newsletter:
    email address

VIII. Copyright

  1. The owner of the Service and the copyright to the service is the Service Provider.
  2. Some data posted on the Service is protected by copyright belonging to companies, institutions, and third parties, not related in any way to the Service Provider, and is used based on obtained licenses, or based on a free license.
  3. Based on the Act of February 4, 1994 on copyright, it is prohibited to use, copy, reproduce in any form, and store in search systems except Google, Bing, Yahoo, NetSprint, DuckDuckGo, Facebook, and LinkedIn any articles, descriptions, photos, and any other content, graphic materials, video, or audio available on the Service without written consent or consent provided via Electronic Communication of their legal owner.
  4. According to the Act of February 4, 1994 on copyright, simple press releases, understood as mere information without commentary and assessment by their author, are not protected. The author understands this as the possibility of using information from the texts posted on the service, but not copying the entire or part of the articles unless marked in the specific material shared on the Service.

IX. Changes to the Terms and Conditions

  1. All provisions of the Terms and Conditions may be unilaterally changed by the Service Provider at any time, without giving reasons.
  2. Information about the change of the Terms and Conditions will be sent electronically to Service Recipients registered in the Service.
  3. In the case of changes to the Terms and Conditions, its provisions come into effect immediately after its publication for Service Recipients without an account in the Service.
  4. In the case of changes to the Terms and Conditions, its provisions come into effect with a 7-day transition period for Service Recipients with accounts registered before the change of the Terms and Conditions.
  5. It is considered that any Service Recipient who continues to use the Service after the change of the Terms and Conditions accepts it in full.

X. Delivery and Fulfillment Time

The order processing and shipping time will not exceed 7 business days after payment has been credited or the COD payment option has been selected. However, in most cases, it takes no more than 1 business day. The Service Provider makes every effort to ensure that orders are shipped as quickly as possible, in accordance with available resources and logistical capabilities.

XI. Final Provisions

  1. The Service Provider is not responsible in any way, to the extent permitted by applicable law, for the content transmitted and published in the Service by Service Recipients, for their truthfulness, reliability, authenticity, or legal defects.
  2. The Service Provider will make every effort to ensure that the Service’s services are offered continuously. However, it is not responsible for disruptions caused by force majeure or unauthorized interference by Service Recipients, third parties, or the activities of external automated programs.
  3. The Service Provider reserves the right to change any information posted on the Service at a time chosen by the Service Provider, without the need to notify Service Recipients using the Service’s services.
  4. The Service Provider reserves the right to temporarily, completely, or partially disable the Service to improve it, add services, or perform maintenance, without prior notice to the Service Recipients.
  5. The Service Provider reserves the right to permanently disable the Service without prior notice to the Service Recipients.
  6. The Service Provider reserves the right to assign in part or in full all of its rights and obligations related to the Service, without the consent and possibility of objections by Service Recipients.
